Mandatory environmental labeling of packaging
Mandatory environmental labeling of packaging
On Sept. 11, 2020, Legislative Decree No. 116 of Sept. 3, 2020, implementing EU Directive 2018/851 on waste, and Directive (EU) 2018/852 on packaging and packaging waste, was published in the Official Gazette. Article 3(3)(c) of the decree made amendments to paragraph 5 of Article 219 of Legislative Decree No. 152 of April 3, 2006 (and subsequent updates and amendments), “Environmental Regulations,” on the subject of “Criteria informing packaging waste management activities.”
Faced with the objective operational difficulties in providing for the direct affixing of environmental labeling on packaging for certain situations, in a note dated May 17, 2021, the Ministry of Ecological Transition clarified how to deal with so-called Neutral Packaging in general, with particular reference to those intended for commercial/industrial channels and/or possible semi-finished products. Since this is B2B packaging, identification of the packaging composition material can be conveyed and communicated by the manufacturer on the transport documents accompanying the goods, or on other external media, including digital.
